Honorable Senado:
Considerando, que la Comisión Nacional sobre Prisión Política y Tortura, llamada también Comisión Valech, fue creada por el decreto supremo N° 1.040, de 2003 como un órgano asesor del Presidente de la República, teniendo por objeto determinar las personas que sufrieron privación de libertad y torturas por razones políticas, a través de actos de agentes del Estado o de personas a su servicio, en el período comprendido entre el 11 de septiembre de 1973 y el 10 de marzo de 1990. Del mismo modo, la Comisión debía también proponer medidas de reparación al Presidente de la República para las víctimas que identificara y elaborara un informe de toda esta labor.
Habida cuenta de que, la Comisión recibió testimonios a través de entrevistas personales en todo el territorio de la República, durante un período de seis meses, y en más de 40 países del mundo, donde las personas entregaron sus testimonios por escrito.
Considerando que al final del proceso, fueron reconocidas como víctimas de prisión política y tortura 28.459 personas, las que corresponden a 34.690 detenciones. Del total de personas, 1.244 eran menores de 18 años, considerando incluso a 176 eran menores de 13 años. Un primer informe, con los nombres de 27.255 víctimas, fue entregado al Presidente de la República en noviembre de 2004. En ese momento, el Presidente solicitó hacer una nueva revisión de los testimonios presentados a través de la dictación de un nuevo decreto supremo, el N° 1.086 de 2004.
